Terms and Conditions
OBJECT
This constitutes an adhesion contract for the use of the website fsv.org.mx and/or condescuento.com (hereinafter referred to as the "Website") entered into by: on the one hand, its legal representative (hereinafter "Fundación Selva Verde," Registered Trademark), in its capacity as the responsible party, and on the other hand, the "User," both parties subject to the provisions of this document.
ACCEPTANCE OF TERMS AND CONDITIONS
By accessing and using this "Website" identified by the domain name www.fsv.org.mx and/or www.condescuento.com, owned by Fundación Selva Verde A.C., the "User" is accepting the Terms and Conditions of Use contained in this contract and expressly declares acceptance using electronic means, in accordance with the provisions of Article 1803 and other relevant provisions of the Federal Civil Code.
For the purposes of this contract, the parties agree that by "User," it shall mean any person of any nature who accesses the "Website www.fsv.org.mx and/or www.condescuento.com and/or any of the subpages displaying its content and/or any person of any nature who registers and/or uses any of the services offered through this "Website."
In the event of not fully and completely accepting the Terms and Conditions of this contract, the "User" must refrain from accessing, using, and viewing the "Website" and/or any other service offered by "Fundación Selva Verde."
If the "User" accesses, uses, and views the "Website," it will be considered an absolute and express acceptance of the Terms and Conditions of Use stipulated herein, as well as other documents incorporated into them by reference, and compliance with applicable laws and regulations according to current legislation for the use of the "Website."
"Fundación Selva Verde" will not retain an individual copy of this agreement between the "User" and "Fundación Selva Verde," so it is recommended that the "User" keeps a copy of these Terms and Conditions of Use for their own records.
In the event that the "User" violates the provisions of these Terms and Conditions of Use, "Fundación Selva Verde" may cancel their usage, exclude the "User" from future transactions, and/or take legal action it deems appropriate for its interests.
USE OF THE SITE www.condescuento.com and/or www.fsv.org.mx
The User and "Fundación Selva Verde" agree that:
To be able to use the "Website," the User must be at least 18 years old or accessing under the supervision of a parent or legal guardian.
"Fundación Selva Verde A.C." grants a non-transferable and revocable license to use the "Website," under the Terms and Conditions of Use described, for the purpose of purchasing personal items sold on the same "Website." The User may only print and/or copy any information and/or image contained or published on the "Website" www.condescuento.com and/or www.fsv.org.mx exclusively for personal use, and the commercial use of such information is expressly and strictly prohibited.
In the case of being a legal entity, it will be subject to the provisions of Article 148, Section IV of the Federal Copyright Law. The reprinting, publication, distribution, assignment, sublicense, sale, electronic reproduction, or by any other means, in whole or in part, of any information, image, document, or graphic appearing on the website www.condescuento.com and/or www.fsv.org.mx, for any use other than personal non-commercial use, is expressly prohibited to the User unless they have the prior written authorization of "Fundación Selva Verde." Any violation of these Terms and Conditions of Use will result in the immediate revocation of the license granted in this section, without prior notice.
Certain services and related features that may be available on www.condescuento.com and/or www.fsv.org.mx may require registration or subscription. The User acknowledges that, by providing personal information, they grant "Fundación Selva Verde" the authorization indicated in Article 109 of the Federal Copyright Law. If the User decides to register or subscribe to any of these services or related functions, they commit to providing accurate and up-to-date information about themselves and to promptly update that information if there are any changes.
Each User of the site is solely responsible for keeping passwords and other account identifiers secure. The account holder is fully responsible for all activities that occur under their password or account. Furthermore, the User must notify "Fundación Selva Verde" of any unauthorized use of their password or account. In no way will "Fundación Selva Verde" be liable, directly or indirectly, for any loss or damage of any kind incurred as a result of the User's failure to comply with this section.
During the registration process, the User agrees to receive promotional emails from www.condescuento.com and/or www.fsv.org.mx. However, later on, they can choose not to receive such promotional emails by clicking on the link at the bottom of any promotional email.
"Fundación Selva Verde A.C." reserves the right to block access or partially or completely remove any information, communication, or material that, in its sole judgment, may be: i) abusive, defamatory, or obscene; ii) fraudulent, deceptive, or misleading; iii) a violation of copyright, trademarks, confidentiality, trade secrets, or any intellectual property rights of a third party; iv) offensive; or v) in any way contrary to the provisions of this contract.
"Fundación Selva Verde A.C." does not presume that the content of its "Website" can be legally viewed outside of the United Mexican States. Access to the content may not be legal for certain individuals or in certain countries. If the User accesses the content from outside the United Mexican States, they do so at their own risk and are responsible for compliance with the laws within the jurisdiction where the User is located.
Users are prohibited from violating or attempting to violate the security of the "Website" and affiliated websites of "Fundación Selva Verde," including, for example: accessing data to which the User is not authorized to use or logging into a server or account for which the User does not have authorized access; attempting to examine, scan, or test the vulnerability of a computer system or network or breach security or authentication measures without proper authorization; attempting to interfere with the use of any other User, hosting service, or network, including, without limitation, transmitting a virus to the Website or affiliated websites of "Fundación Selva Verde."
The User acknowledges that violations of the computer system or network security may result in civil or criminal liabilities. "Fundación Selva Verde" will investigate situations that may involve such violations and reserves the right to report such actions to the authorities; "Fundación Selva Verde" will cooperate with the competent authority in the investigation of such violations as established by applicable law.
For proper access to the "Website," Users must have the necessary equipment and facilities for their Internet connection (computer, phone, modem, programs, etc.), and the use of these devices is their total responsibility.
"Fundación Selva Verde A.C." is exempt from any responsibility arising from interruptions or suspensions of the Internet access service caused by failures in the telecommunications system, power supply, fortuitous events, force majeure, or third-party actions that may disable the equipment providing access to the network.
Therefore, "Fundación Selva Verde" is not responsible for any damage, harm, or loss to the User caused by system failures, server failures, or Internet failures. "Fundación Selva Verde" will also not be responsible for any virus that may infect the User's equipment as a result of accessing, using, or examining the Site or as a result of any data, files, images, text, or audio transfers contained therein. Users may not attribute any responsibility or claim damages due to technical difficulties or failures in systems or the Internet. "Fundación Selva Verde" does not guarantee continuous or uninterrupted access and use of the "Website." The system may eventually be unavailable due to technical difficulties or Internet failures or any other circumstances beyond "Fundación Selva Verde"; in such cases, efforts will be made to restore it as quickly as possible without any liability being attributed. "Fundación Selva Verde" will not be responsible for any errors or omissions contained on the "Website."
INTELLECTUAL AND INDUSTRIAL PROPERTY, AND COPYRIGHT
"Fundación Selva Verde A.C." acknowledges being the sole owner of intellectual property rights, whether registered or unregistered, on the site www.condescuento.com and/or www.fsv.org.mx, including but not limited to: projects, software, source code, graphics, photographs, videos, images, music, sound, texts, logos, trademarks, domain names, trade names, and data included in the "Website" www.condescuento.com and/or www.fsv.org.mx. The entire content of our page is also protected by copyright as a collective work under Mexican copyright laws and international conventions. All rights reserved.
Users are warned that these rights are protected by current Mexican and international legislation on intellectual and industrial property and copyright.
Copying, reproduction, adaptation, modification, distribution, marketing, licensing, sending, disclosure, public communication, and/or any other action that generates an infringement of Mexican or international legislation in the field of intellectual and/or industrial property is prohibited. The use of the contents of the "Website" without the express and written authorization of "Fundación Selva Verde" is strictly prohibited.
If the User transmits to "Fundación Selva Verde" any information, programs, applications, software, or in general any material that needs to be licensed through the "Website" www.condescuento.com and/or www.fsv.org.mx, the User hereby grants "Fundación Selva Verde" a perpetual, universal, free, non-exclusive, worldwide, and royalty-free license, including the rights to sublicense, sell, reproduce, distribute, transmit, create derivative works, exhibit, and publicly perform them.
The above paragraph also applies to any other information that the User sends or transmits to "Fundación Selva Verde," including, without limitation, questions, criticisms, comments, and suggestions for renewing or improving the "Website," whether they have been included in any space on the specified page or through other known or future means or modes of transmission. Additionally, when the User submits comments or reviews to the website, they also grant "Fundación Selva Verde" the right to use the name they submit in the context of such review, comment, or any other content.
Therefore, the User expressly waives at this moment to take any action, demand, or claim against "Fundación Selva Verde," its affiliates, or providers for any current or eventual violation of any copyright or intellectual property right derived from the information, programs, applications, software, ideas, and other material that the User sends to the "Website" www.condescuento.com and/or www.fsv.org.mx.
If the User believes that any content posted on the "Website" violates intellectual or industrial property rights, the User may make a notification by contacting the Customer Service Center of "Fundación Selva Verde." The User must provide: true personal data and precise and complete indication of the protected content(s) allegedly infringed by intellectual property rights, as well as the location of such violations on the referred website.
The "Website" contains links to third-party websites. These links are provided only as an advantage of the "Website" for the User and do not imply that "Fundación Selva Verde" has approved the content of such third-party websites. "Fundación Selva Verde" is not responsible for the content of linked third-party websites and makes no representation regarding the content or accuracy of the material on the sites of such third parties. If the User decides to access third-party websites through these links, they do so at their own responsibility and risk.
ADVERTISING MATERIAL
The User acknowledges and accepts that some parts of the "Website" may contain information, images, advertisements, and other advertising or promotional material from third-party sponsors and advertisers (hereinafter "Advertising Material"). Advertisers and sponsors are responsible for ensuring that the Advertising Material submitted for inclusion on the "Website" complies with relevant laws and regulatory codes. "Fundación Selva Verde" is not responsible for any errors or inaccuracies in advertising materials.
Likewise, the User acknowledges and accepts at this moment that said Advertising Material is protected by the laws applicable to intellectual and industrial property.
